At Tagyeer Real Estate, we are committed to providing transparent, professional, and fair real estate services. This Refund & Cancellation Policy explains the circumstances under which payments made through our website or in connection with our services may be cancelled or refunded.

1. General Policy

Payments made to Tagyeer Real Estate may relate to various real estate services, including brokerage services, property reservations, administrative services, property management or property-related services, and other agreed services.

Eligibility for cancellation or refund will depend on:

The nature and purpose of the payment;

Whether the relevant service has commenced or been completed;

The applicable agreement between the parties;

Whether the payment was collected for Tagyeer Real Estate or on behalf of a third party; and

Applicable laws and regulations of the Kingdom of Bahrain.

Nothing in this Policy limits or excludes any rights or remedies available to a customer under mandatory applicable law.

2. Property Reservations and Deposits

Where a payment is made to reserve a property, the cancellation and refund provisions contained in the applicable Reservation Agreement, Sale and Purchase Agreement, or other property-specific agreement shall apply.

Where Tagyeer Real Estate collects a reservation payment or deposit on behalf of a property owner, landlord, developer, seller, or other third party, the payment may also be subject to the terms and conditions applicable to that transaction.

For off-plan property transactions, reservation deposits, cancellations, and refunds shall be handled in accordance with applicable Bahrain laws and the requirements and regulations of the Real Estate Regulatory Authority (RERA).

Nothing in this Policy is intended to restrict any cancellation or refund right granted under applicable law.

3. Brokerage Fees and Commissions

Brokerage fees and commissions shall become payable in accordance with the applicable brokerage agreement, the nature of the transaction, and applicable Bahrain laws and regulations.

Where Tagyeer Real Estate has performed the agreed brokerage services and its brokerage activities have resulted in the conclusion of the relevant transaction, any brokerage fee or commission that has become legally and contractually due shall generally be non-refundable, unless otherwise agreed in writing or required by applicable law.

Where a transaction does not proceed or is subsequently cancelled, entitlement to a refund, if any, will depend on the circumstances, the applicable agreement, the stage reached in the transaction, and applicable law.

4. Service and Administrative Fees

Fees relating to services that have already been completed or substantially commenced may be non-refundable to the extent permitted by applicable law.

Where the requested service has not commenced, the customer may submit a cancellation and refund request.

Where applicable and permitted by law, reasonable costs or expenses already incurred by Tagyeer Real Estate in preparing for or providing the requested service may be deducted from an approved refund, provided such charges have been disclosed or agreed with the customer where required.

5. Duplicate or Incorrect Payments

If a customer is charged more than once for the same transaction, or an incorrect amount is charged as a result of a payment or processing error, the customer should contact Tagyeer Real Estate as soon as reasonably possible.

Once the error has been verified, the duplicate payment or incorrectly charged amount will be refunded using the original payment method wherever reasonably possible.

6. Refund Requests

To request a refund or cancellation, the customer should contact Tagyeer Real Estate and provide the following information where applicable:

Full name;

Contact details;

Property or transaction reference;

Payment date and amount;

Payment receipt or transaction reference; and

Reason for the cancellation or refund request.

Tagyeer Real Estate may request additional documents or information where reasonably necessary to verify the transaction, confirm the customer's identity or authority, and assess the request.

Submission of a refund request does not automatically guarantee that a refund will be approved. Each request will be assessed in accordance with the applicable agreement and Bahrain law.

7. Refund Processing

Once a refund request has been reviewed and approved, Tagyeer Real Estate will initiate the refund using the original payment method, wherever reasonably possible.

The time required for the refunded amount to appear in the customer's account may vary depending on the payment method, payment gateway, card issuer, bank, or other financial institution.

Tagyeer Real Estate shall not be responsible for processing delays caused solely by banks, card issuers, payment gateways, or other third-party payment service providers.

Any payment gateway, bank, card processing, or similar third-party charges that are not refundable to Tagyeer Real Estate may be deducted from the refunded amount only where permitted by applicable law and where appropriately disclosed or agreed with the customer.

8. Payments Collected on Behalf of Third Parties

Where Tagyeer Real Estate facilitates or collects a payment on behalf of a property owner, landlord, seller, developer, or another third party, any refund may be subject to:

The applicable transaction agreement;

The terms governing the relevant payment;

Applicable Bahrain law; and

The refund obligations of the relevant third party.

Tagyeer Real Estate will provide reasonable assistance in processing legitimate refund requests. However, where funds have already been transferred to a third party, Tagyeer Real Estate cannot guarantee repayment unless Tagyeer Real Estate or the relevant third party is legally or contractually required to provide the refund.

9. Cancellation of Property Transactions

Cancellation or termination of a property reservation, tenancy, sale, purchase, brokerage arrangement, property management service, or other real estate transaction shall primarily be governed by the applicable agreement entered into between the relevant parties.

This website Refund & Cancellation Policy does not replace, amend, or override the provisions of any signed Reservation Agreement, Tenancy Agreement, Sale and Purchase Agreement, Brokerage Agreement, Property Management Agreement, or other legally binding agreement.

In the event of any inconsistency, the applicable agreement shall apply, subject always to any mandatory provisions of Bahrain law and applicable regulatory requirements.

10. Fraudulent or Unauthorized Transactions

If a customer believes that a payment was made fraudulently or without authorization, the customer should immediately contact their bank or card issuer and notify Tagyeer Real Estate.

Tagyeer Real Estate reserves the right to request reasonable supporting information and to cooperate with payment service providers, financial institutions, regulators, or competent authorities in investigating suspected fraudulent or unauthorized transactions.

11. Changes to This Policy

Tagyeer Real Estate may update this Refund & Cancellation Policy from time to time to reflect changes in our services, payment arrangements, business practices, or applicable legal and regulatory requirements.

The latest version will be published on our website together with the date of the most recent update.

Any update will not retrospectively reduce rights already accrued under an existing transaction or applicable law.

12. Governing Law

This Refund & Cancellation Policy shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Bahrain, including applicable regulations, rules, and decisions issued by the Real Estate Regulatory Authority (RERA) where relevant.

Nothing in this Policy excludes the jurisdiction or authority of any competent regulator, tribunal, or court where such jurisdiction applies under Bahrain law.
